TERMS AND CONDITIONS OF USE (EN)

These Terms and Conditions (“Terms”) govern access to and use of www.ambassadormelissawells.com (“the Website”), a digital memorial dedicated to preserving the life, memory, and humanitarian legacy of Melissa Foelsch Wells.

By accessing, browsing, or contributing content to the Website, you agree to be legally bound by these Terms. If you do not agree, you must discontinue use of the Website immediately.

The Website is a non-commercial digital memorial curated by the heirs of Melissa Foelsch Wells, who serve as its legal custodians.

  • international copyright treaties,
  • posthumous personality rights,
  • and the rights held by the heirs of Melissa Foelsch Wells.

3.4. Manipulations and Deepfakes

You are prohibited from:

  1. creating or sharing AI-generated replicas, deepfakes, fake audio, altered images, or simulated content involving Melissa Foelsch Wells or individuals appearing in the archive.

3.5. Misuse of Institutional Symbols

  • your submission does not violate confidentiality or copyright;
  • the material is appropriate and respectful;
  • it contributes positively to the historical and memorial purpose of the Website.

By submitting content, you grant the Website a perpetual, non-exclusive, royalty-free, worldwide license to display and preserve the material as part of the memorial, and you retain copyright to your submission unless otherwise agreed.

  1. Moderation

The heirs family of Melissa Foelsch Wells act as the official moderator.

All submissions may be:

  • reviewed prior to publication,
  • reviewed after publication,
  • removed or restricted at any time.

The Website reserves the right to reject or remove any content that:

The heirs explicitly reserve the right to pursue all legal remedies, civil, criminal, administrative, and international, against misuse, defamation, distortion, unauthorized reproduction, exploitation, or disrespectful conduct.

  1. Takedown Requests

Any individual, institution, or rights holder may request the removal of:

  • their own image or personal data;
  • content that violates dignity, privacy, or safety;
  • copyrighted material published without authorization;
  • material inconsistent with humanitarian, diplomatic, or ethical principles.

Requests must be submitted via the official contact channel listed below and the Curator will:

  • respond within 15 days,
  • prioritize urgent humanitarian or safety-related requests,
  • remove harmful or illegal content immediately upon verification,
  • maintain discretion regarding archival or editorial decisions.

This process does not guarantee reinstatement of removed content.

  1. Amendments

These Terms may be updated periodically. A revised version will be published with a new Effective Date.

  1. Governing Law and Jurisdiction

These Terms are governed by the laws of Brazil, without regard to conflict-of-law provisions.

Users agree that any dispute will be resolved in the courts of São Paulo, Brazil, unless required by law to be resolved in another jurisdiction.

Melissa Foelsch Wells

Melissa Foelsch Wells was a distinguished American diplomat whose career spanned over four decades, with postings in countries including Trinidad & Tobago, France, the United Kingdom, Brazil, Guinea-Bissau, Cape Verde, Mozambique, Zaire, and Estonia, as well as key roles in the United Nations focusing on development, emergency relief, and disability prevention.

Born in Tallinn, Estonia, in 1932, she emigrated to the United States as a child and later earned a B.S. cum laude in Foreign Service from Georgetown University.

Fluent in six languages, Wells excelled in international diplomacy and global cooperation, was married to former diplomat Alfred Washburn Wells, and had two sons and three grandchildren.

After retiring, she lived in Spain and the United States, leaving a lasting legacy of dedication to public service and fostering international relations.
